- In November 2024, Washington voters enacted Initiative 2066 (I-2066), which contains 13 provisions and “concerns regulating energy services, including natural gas or electrification.” Climate Solutions, et al. challenged I-2066, arguing that it violates article II, section 19, and section 37 of the state constitution. Article II, section 19, limits legislation to one subject and requires that this subject be reflected in the title. Article II, section 37, requires that legislation set forth the existing laws it amends. The superior court determined that I-2066 violates both requirements and is unconstitutional in its entirety. The Supreme Court granted direct review to decide whether I-2066 violates article II, sections 19 or 37, and if so, whether the entire initiative is unconstitutional or its provisions are severable?
