State of Washington v. Aaron Justin Fulk
The trial court found Fulk not guilty of murder in the first degree by reason of insanity when he killed his victim believing that the victim was non-human. Over defense’s objection, the trial court excluded evidence of diminished capacity. On appeal, Fulk argues, among other things, he did not have the requisite mens rea to commit murder in the first degree because he did not intend to kill another person. COA# 875876.
