Personal Restraint Petition of Stephen P. Dowdney, Jr.
While in prison, the Department of Corrections put Stephen Dowdney on “assigned to cell” status as a “program” for not participating in work-based programming. He was later infracted for violating it by being out of his cell. Dowdney filed a personal restraint petition claiming the “assigned to cell” status as programming was unconstitutional and he was denied due process regarding the sanction. Dowdney was released from prison in July 2025, and DOC asserts the matter in therefore moot. COA# 867776. Snohomish County Superior Court# 16-1-00712-5.
Pho An Restaurant, Inc. et ano v. WA State Department of Labor & Industries
Pho An Restaurant and its owner, Nga Le, received a citation from the Department of Labor and Industries, claiming unpaid wages and tips for two former employees. An Administrative Law Judge issued an order requiring Pho An to pay the former employees wages, tips, and interest. The L&I director substantially affirmed the ALJ. Pho An and Le appeal asserting among other things, it was error to conclude that Le’s husband was not entitled to receive tips, and the calculation of the daily totals for food sales and tips during the COVID inside dining closure was inaccurate. Oom Living, LLC, et al v. City of Seattle; Seattle Public Utilities
The City of Seattle appeals the trial court’s order on summary judgment concluding that the City’s permit condition requiring Oom Living to construct a water main extension violated the doctrine of unconstitutional conditions and state and local law.
