Dwyer Dale v. Kia America, Inc


  • Dwyer Dale bought a 2022 Kia vehicle and later alleged it had substantial and dangerous defects, resulting in damages including personal injury and lost wages. After mandatory Lemon Law arbitration, Kia was ordered to repurchase the vehicle. Dale then initiated this action in superior court, alleging violations of the Consumer Protection Act and the Automobile Dealers and Manufacturers Act. Kia moved for summary judgment on all claims, asserting defenses of claim preclusion and waiver. The trial court granted the motion. Dale appeals. COA# 881817.
