- Tracy Hopkins signed an arbitration agreement with her employer, Bristol -Meyers Squibb (BMS) in 2023. BMS terminated Hopkins in 2024. Hopkins sued BMS for age discrimination and wrongful termination. BMS moved to compel arbitration, and the trial court denied the motion. BMS appeals asserting that the court misinterpreted the mutual arbitration agreement, that a binding promise is sufficient consideration to create a valid arbitration agreement, and the court erred by resolving the issue of enforceability that was delegated to an arbitrator.
