- Petitioners were entitled to workers’ compensation benefits under the Industrial Insurance Act (IIA), Title 51 RCW. They challenge the amount of the reduction in their pensions under the statute authorizing an offset for federal social security retirement benefits, RCW 51.32.225. Each worker had elected a survivorship option for their pension under RCW 51.32.067, resulting in reduced pension rates in exchange for survivorship benefits. Petitioners argue that according to the plain language of RCW 51.32.220(5), this reduced rate due to the offset of federal benefits cannot go below their pre-actuarially reduced pension rates.
