McCallum v Smith: Maxine McCallum and Corey Smith own adjoining rural properties outside of Tacoma. The previous owner of one of the parcels built a fence separating the parcels. In 2021, believing that the fence inaccurately divided the properties, McCallum sued to quiet title as to a disputed strip along the western boundary of her property and later amended her complaint to include a second parcel purchased on the southern boundary. Smith asserted counterclaims of adverse possession and boundary by mutual acquiescence. In early 2022, the parties filed cross-motions for summary judgment. Trial court granted McCallum’s motion as to the Southern Strip but found that there were triable issues of fact as to the Western Strip and denied Smith’s motion. Following a three-day bench trial on the Western Strip, the court ruled in favor of McCallum. The court also granted McCallum’s request for attorney fees. Smith appeals. COA #861751.
