Division 1 Court of Appeals

State v Aguilar: Alfonso Aguilar appeals his convictions for rape in the 1st degree, robbery in the 1st degree, burglary in the 1st degree, assault in the 2nd degree, and kidnapping in the 1st degree. He contends that the convictions violate double jeopardy, violate jury unanimity protections because insufficient evidence supported some of the elevating factors for the charges and because the court did not give the jury an unanimity instruction after the state presented evidence of multiple acts for some of the charges, and that his offender score was miscalculated because some charges involved the same criminal conduct
