Malini Wilkerson v. WA St. Dept. of Corrections
- In May 2019, the Department of Corrections (DOC) discharged Michael Miller from community custody supervision. A week later, Miller shot and killed Taylor Ester. Ester’s estate initiated a complaint against DOC, alleging DOC was grossly negligent and but for that negligence, Miller’s supervision would have been revoked, and he would have been incarcerated before the shooting occurred. After the testimony concluded at trial, DOC brought a motion for a directed verdict, which the court granted. The Estate appeals, contending the trial court erroneously excluded its expert’s opinion, and it erred when it granted DOC’s CR 50 motion dismissing the case. COA #886932.
