McSorley v. The Everett Clinic
Dr. McSorley sued her former employer, The Everett Clinic (TEC), and former colleagues alleging gender based discrimination in violation of WLAD. During discovery, TEC waived privilege for Dr. McSorley’s peer review file. Dr. McSorley motioned to compel disclosure for comparator peer review files, claiming TEC had impliedly waived privilege as to those files. The trial court agreed and ordered TEC to produce privileged peer review files. TEC sought and was granted discretionary review of the trial court’s order. COA # 863258.
