Division 1 Court of Appeals

State v. Peterson

Darryl G. Peterson challenges his conviction for murder in the first degree on various grounds, including the trial court’s refusal to discharge his counsel; the trial court’s denial of his motion to dismiss based on DNA testing conducted nearly five years after his arrest; and the admission of certain videos. He also claims his counsel’s failure to object to audio of other admitted videos constituted ineffective assistance, contends there was cumulative error, and challenges the imposition of the VPA. COA # 855531. King County Superior Court # 17-1-01701-5.

State v. Grandemartinez

In 2023, the State charged Emmanuel Grandemartinez with assault in the second degree with a deadly weapon for his assault on a fellow inmate. At trial, the court instructed the jury on the elements of assault and the special verdict form for assault with a deadly weapon. During deliberation, however, the jury filled out the wrong verdict forms. The court provided them with additional instruction and new verdict forms. The jury found Grandemartinez guilty as charged. Grandemartinez appeals. COA # 856731, Snohomish County Superior Court # 20-1-01242-31.

Millar v. Hartwell

Temporary Housing, Inc. (THI) assisted Anakka Hartwell in locating temporary alternative housing covered by her insurance through Liberty Insurance. THI arranged and paid for rental of a house owned by Joel Millar. After Liberty declined to extend the rental, THI stopped paying rent, but Hartwell remained on the property. Millar filed suit against THI, Liberty, and Hartwell for declaratory relief, breach of contract, breach of the duty of good faith and fair dealing, intentional or negligent misrepresentation, violation of the Washington Consumer Protection Act (CPA), and equitable estoppel. He appeals the trial court’s summary judgment dismissal of his claims. COA # 858769. King County Superior Court # 22-2-12457-1.
