In March 2022, Richard Rotter resisted Officer Rocha’s arrest and then shot and killed him in an Everett Starbucks parking lot. Rotter appeals his convictions and sentence. He argues that (1) there is insufficient evidence of premeditation to support his aggravated first degree murder conviction, (2) Officer Rocha’s seizure lacked reasonable suspicion, (3) the prosecutor committed repeated misconduct, (4) Detective Mueller provided improper opinion testimony, (5) the errors amounted to cumulative error, (6) the to-convict instruction for count 3 lacked an essential element, and (7) the court erred by imposing a victim penalty assessment.
