Hagel v. Bui
The Hagels sued the Buis over use of a shared dock, seeking enforcement of an easement agreement and a temporary restraining order. The trial court found in favor of the Hagels. On appeal, the Buis claim the (1) the trial court erred by not granting their motion to dismiss the Hagels’ injunctive relief, (2) by denying their CR 12(b) motion regarding the indemnity clause,(3) by not striking late raised issues, (4) by allowing certain testimony, (5) by disallowing other evidence, and (6) finding that the Buis are entitled to fees on appeal.
