Patricia Smith-Wade suffered an industrial injury and filed for worker’s compensation benefits with the Department of Labor and Industries. After the Department closed her claim, she appealed to the Board of Industrial Insurance Appeals and then the trial court. She now appeals a trial court judgment affirming the Board after a jury trial. She argues the trial court erred by (1) considering GLY’s motion in limine to exclude expert witness Nicholas Choppa’s testimony, (2) granting the motion in limine, (3) refusing to give Smith-Wade’s proposed jury instruction 4, and (4) giving jury instruction 13.
