Bremerton School District v. Schools Insurance Assoc. of WA – After Bremerton School District declined to renew Joseph Kennedy’s coaching contract, Kennedy sued the District for declaratory and injunctive relief and for his attorney fees. The Supreme Court of the United States later determined that Kennedy was entitled to relief and ordered the district court to grant summary judgment in Kennedy’s favor. The District and Kennedy later reached a $1,775,000 settlement for Kennedy’s attorney fees. The District then sought indemnification from the Schools Insurance Association of Washington, which denied coverage. The District proceeded to sue SIAW and move for judgment on the pleadings. The trial court determined that the insurance policy did not provide coverage for an award of attorney fees and denied the District’s motion. The District appeals. COA #858114.
