Division 1 Court of Appeals

State of Washington v Niceto Amor Canete: Canete appeals his conviction for one count of child molestation first degree and one count of rape of a child second degree. He asserts that the trial court violated his right to compel witnesses and commented on the evidence with a jury instruction stating a victim’s testimony need not be corroborated. He also contends that his attorney was ineffective for their failure to interview a key witness during the five years the case was pending trial. He further asserts that the prosecutor engaged in misconduct in closing argument.
