- This case presents two questions of first impression in Washington State. (1) Whether a person committed under chapter 71.09 RCW can propose their own less restrictive alternative (LRA) placement when the Department of Social and Health Services’ (DSHS) secretary designee has authorized them to petition for conditional release and has proposed a placement meeting the statutory requirements. (2) Whether a trial court may grant summary judgment (CR 56) in chapter 71.09 RCW proceedings and based on the State’s argument that the committed person should receive conditional release to DSHS’s proposed LRA placement.
