State of Washington v Dale Robertson Mitchell. Dale Mitchell appeals the re-imposition of his exceptional 25-year sentence for burglary and rape from 1996. Mitchell contends the trial court erred by not reducing or fully reconsidering his exceptional sentence even though his offender score was now lower because of a supreme court order vacating his felony drug possession convictions. Additionally, Mitchell alleges violations of his Sixth Amendment rights to have his resentencing decided by a jury and to effective assistance of counsel, among other claims. COA #835688.
