Oral argument:
Geoffrey G. McLellan et al v. Nicholas W. Brown (Does restricting firearm possession among individuals convicted of two or more DUIs in seven years violate the federal Second Amendment?) Case #103799-6
- RCW 9.41.040(2)(a)(i)(D) bars individuals who are convicted of two or more DUIs in a seven-year period (if at least one of those convictions took place after July 2023) from possessing firearms in Washington State. After five years with no additional qualifying offenses, individuals may petition to have their firearm rights restored. Two individuals who were denied licenses to carry concealed pistols challenged the law as a violation of their right to bear arms under the Second Amendment to the U.S. Constitution. Does RCW 9.41.040(2)(a)(i)(D) violate the federal Second Amendment?
