  • Christopher Posey, a Black man, was found guilty by an all-white jury of several crimes against his former girlfriend, a white woman. In the jury’s presence, the State questioned Mr. Posey about a photo of him holding a gun and cash, eliciting from Mr. Posey that the gun and money were props for a “hip hop rap” music video. Did the State commit race-based misconduct by questioning Mr. Posey about the photo? Was Mr. Posey’s counsel ineffective in failing to object to said questioning?
