  • Whether the trial court erred: (1) by admitting the State’s evidence and expert testimony regarding DNA extracts that were allegedly obtained from a condom that was lost or destroyed by an analyst hired by the police investigators to complete DNA testing, (2) by admitting the State’s evidence and expert testimony regarding the DNA mixture obtained more than thirty years after the evidence items were collected by the police, (3) by entering its findings of facts numbers 5, 24a, 28, 54, 55, 57, 58, and 63, and (4) by finding sufficient evidence to convict Aguirre of premeditation at the time of his offense.
