- The jury convicted Vasquez of first-degree child rape, first-degree child molestation, and third-degree child molestation for sexually assaulting his daughter, and the court ordered an indeterminate sentence of 200 months to life imprisonment. On appeal, Vasquez argues the court erred in dismissing a juror in violation of GR 37, the prosecutor committed misconduct throughout the trial and closing arguments, the court erred in admitting out-of-court statements, the court erred in permitting a sexual assault nurse examiner to testify about general characteristics of sexual assault victims, and the State failed to present sufficient evidence to prove third-degree child molestation.
