Division 1 Court of Appeals

Neh Kuh Neh, Et Ano, v. Tiblets Tebabal

Neh Kuh Neh and his wife Say Mo were involved in an automobile collision with Tiblets Tebabal. Neh and Mo sued Tebabal for damages. A jury found Tebabal liable and awarded damages to Neh and Mo. On appeal, Tebabal argues that the trial court committed prejudicial error by requiring the parties to argue a GR 37 challenge and by conducting a GR 37 analysis in the presence of the jury. Tebabal asks for reversal and remand for a new trial. Additionally, Tebabal contends that the trial court erred by excluding certain evidence of Mo’s injuries, allowing certain testimony regarding future medical costs, allowing the jury to award unsupported future economic damages, and by denying Tebabal’s motion for a new trial despite cumulative error. COA# 880811.
