  • Tenant Navneet Kaur appealed the trial court’s dismissal on summary judgment her claims of negligence, breach of contract, violation of Residential Landlord-Tenant Act, and nuisance. Kaur alleged that her health issues were a result of pathogen and mold exposure from the water leak inside her apartment unit. The trial court entered summary judgment because the respondents were not the apartment owners at the time of the water leak. On appeal, Kaur argues, among other things, the respondents had constructive knowledge of the conditions inside the unit, and the water leak was the proximate cause of her illness. COA #883925.
