In re The Matter of the Survivor’s Trust Under the Filer Living Trust Agreement

 

  • Matthew Veeder was appointed successor trustee of various trusts established by Sallie Filer and Don Filer to benefit the Filer’s children. Tod Filer, one of the Filers’ children, alleged Veeder breached various duties, and in response, Veeder filed a petition to find insufficient cause to remove him as successor trustee. The trial court summarily dismissed Veeder’s petition with prejudice. Veeder argues, among other things, that the trial court erred by finding there was cause to remove him and finding the exculpatory clause unenforceable. In Tod Filer’s cross-appeal, he argues the attorney fees awarded in his favor should be paid by Veeder in his individual capacity and not from the trust. COA# 884948.
