Marcus Hardiman v. TK Elevator Corporation, et al
Hardiman, relying on the Sales Representative Act, sued his former employer TKE for failing to pay commissions on sales he made prior to leaving employment. Discretionary review was granted on two issues: whether TKE was a principal, and whether Hardiman was a sales representative under RCW 49.48.150. TKE argues, among other things, that it is not a principal because it did not manufacture, distribute, import, or produce a product, and Hardiman is not a sales representative because he did not solicit orders for purchase at wholesale.
