Pho An Restaurant, Inc. et ano v. WA State Department of Labor & Industries
Pho An Restaurant and its owner, Nga Le, received a citation from the Department of Labor and Industries, claiming unpaid wages and tips for two former employees. An Administrative Law Judge issued an order requiring Pho An to pay the former employees wages, tips, and interest. The L&I director substantially affirmed the ALJ. Pho An and Le appeal asserting among other things, it was error to conclude that Le’s husband was not entitled to receive tips, and the calculation of the daily totals for food sales and tips during the COVID inside dining closure was inaccurate.
