Balaji Logistics Inc. v. David Allen Martinson
Balaji Logistics, Inc., purchased Kevin Hager’s excavating company, Builders Supply, Inc. Balaji sued Hager and a former key employee, David Martinson, asserting claims of tortious interference with business expectancy and trade secret misappropriation, breach of contract by Hager, and a breach of fiduciary duty by Martinson. The jury found against Balaji on all its claims and the trial court awarded Martinson fees. The trial court granted Balaji’s motion for new trial as to Hager but denied it as to Martinson.
