Carly Ann Gilder v. Sabrina Austria Valich
- Reed McClure represented defendants in a motor vehicle accident case. During settlement negotiations between the parties, Reed McClure became aware of a potential conflict and advised the defendants to retain independent counsel. The plaintiff believed that the parties had reached a settlement, but Reed McClure continued to litigate the case. The court ordered enforcement of the settlement agreement, for Reed McClure to pay attorney fees, and imposed sanctions. Reed McClure appeals, arguing that the settlement agreement was not enforceable and did not provide a legal basis for an award of fees and sanctions, that its continued litigation was not frivolous, and that the court abused its discretion in imposing sanctions.
