DWG Holding Company LLC v. Decathlon Alpha, III, L.P.
- In 2021, DWG Holdings and Decathlon reached a settlement agreement and Decathlon assigned its rights under a previous loan agreement to DWG Holdings in exchange for payment of $1,300,000. DWG Holdings later sued Decathlon for breach of contract, alleging DWG breached the duty of good faith and fair dealing. Decathlon counterclaimed for breach of contract and attorney fees under the indemnity clause of the settlement agreement. Decathlon moved for summary judgment and the court granted it, dismissing DWG Holding’s claim and granting judgment in favor of Decathlon. DWG appeals. COA# 868934.
