Christie Parker v. Aegis Senior Communities LLC, et ano

 

  • Christie Parker sued Aegis Living Mercer Island (Aegis Living) for negligence and violation of the Abuse of Vulnerable Adults statute, Chapter 74.34 RCW. Aegis Living moved to compel arbitration. The trial court denied the motion, finding the Arbitration Agreement unenforceable because it is procedurally and substantively unconscionable. Aegis Living appeals, arguing the Arbitration Agreement is not procedurally unconscionable nor is it substantively unconscionable based on the confidentiality provision, costs provision, discovery limitations, or claim carveouts. It also contends that if certain provisions are unconscionable, the court erred by not severing them.
