In the Receivership of NW Trustee Services, Inc. and RCO Legal, P.S.
- Elliott Bay Asset Solutions, LLC (EBAS) was the general receiver for RCO Legal, PS and its affiliate Northwest Trustee Services, Inc. EBAS employed attorneys to assist with its receivership duties, including a proof of claim that PNC Bank (PNC) submitted for payment. When EBAS filed Notices of Intent to Compensate Professionals (NOICP) for the time that the attorneys incurred, the trial court denied compensation. It also ordered EBAS to hire new attorneys to defend against PNC’s adjunct complaint. EBAS appeals, arguing the court abused its discretion by denying compensation and ordering it to hire new counsel.
