State v. Emanuel Kozma
- Emanuel Kozma was convicted of assault in the first degree while armed with a firearm and unlawful possession of a firearm in the second degree. He argues that he was denied his right to present a defense and to confront witnesses when the court prevented a witness from testifying about his knowledge about the victim’s alleged abusive relationship. He argues he received ineffective assistance because his counsel failed to argue that the witness’s testimony was admissible as “other suspect” evidence. He also argues the cumulative prejudice of these errors denied him a fair trial.
