Division 1 Court of Appeals

State v. Shawn Morgan

Shawn Morgan and Virginia Foy were intimate partners. In January 2024, while Foy was driving and Morgan was in the passenger seat, Morgan attempted to shove Foy’s head into the steering wheel. Later that day at Morgan’s apartment, Morgan threatened Foy’s life and shoved her twice. After Foy went to the apartment she shared with her brother, Morgan showed up and tried to kick down the door. He then rammed his car into Foy’s minivan. Foy’s brother called law enforcement. The State charged Morgan with harassment domestic violence, malicious mischief in the second degree, attempted residential burglary domestic violence, domestic violence in the fourth degree, and resisting arrest. Morgan appeals, among other things, the sufficiency of the evidence and the constitutionality of Washington’s harassment statute.
