Division 1 Court of Appeals

State v. Duran

  • In 2021, the State charged Joshua Duran with rape in the second degree. During jury selection, one of the chosen jurors noted in their juror questionnaire that they did not believe they could be impartial due to nature of the charges against Duran. The jury convicted Duran. Duran appeals asserting that he was deprived of an impartial jury, he was denied the right to present his own defense, and the court erred by admitting prejudicial evidence. COA # 864033, Whatcom County Superior Court #21-1-008783-7.
