A.S. v. Provail
- A.S. sued Provail, alleging sex and disability discrimination under the Washington Law Against Discrimination, among other claims. A.S. alleged that an employee of Provail sexually assaulted her. Both parties filed motions for partial summary judgment that turned, in part, on whether A.S. resided in a place of public accommodation. The trial court granted A.S.’s motion and denied Provail’s. Provail petitioned for, and was granted, discretionary review, arguing that questions of fact should have precluded summary judgment, and that A.S.’s residence was not a place of public accommodation.
