State of Washington v Phillip Renelle Jarvis. (1) Was the appellant unlawfully restrained in several pretrial hearings and his sentencing hearing, (2) do the jury instructions, read as a whole, require the State to prove that the appellant intended to assault the victims named in two of the counts and was there sufficient evidence of this element, (3) did the prosecutor commit misconduct during closing argument by encouraging the jury to convict appellant on an improper basis and by arguing facts outside of the record, and (4) is the Persistent Offender Accountability Act unconstitutional?
