Division 1 Court of Appeals

Parental Rights to J.H.W., Jr.

In 2019, the Department of Children, Youth, and Families (DCYF) initiated dependency proceedings concerning J.H.W.’s two sons, J.W. and K.W. The children were removed from the home and placed with their current caregivers. In 2020, the State arrested J.H.W. and charged him with rape in the second degree and assault. The court sentenced J.H.W. to 158 months of incarceration. In 2024, after a termination trial, the court terminated J.H.W.’s parental rights. J.H.W. appeals asserting that DCYF failed to provide all court-ordered and necessary services, did not prove there was little likelihood his parental deficiencies would be remedied in the near future, failed to establish that continuance of the relationship would diminish the kids’ prospects for early integration into a permanent home, and did not show termination was in the children’s best interests.
