DVPO of Montesi
In 2022, Jessica Montesi (Jessica) obtained a DVPO against Brandon Montesi (Brandon) that required him to surrender any weapons. When Brandon failed to comply with the DVPO, the trial court found him to be in civil contempt and awarded Jessica fees. A year later, Brandon filed a motion asking the court to declare that the weapons-surrender statute violated his right against compulsory self-incrimination, violated the Fourth Amendment, violated the Second Amendment, and violated the separation of powers.
